Case summary

A review of the distributor product, Intercide ZnP-5 DIDP Industrial Fungicide (EPA Reg. No. 1258-1183-1486), was conducted on September 19, 2025, and it was found that the product appeared to be cancelled as of April 21, 2021. Based on a review of the Pesticide Product Label System (PPLS), the registered product, for the distributor product, appears to have been transferred on April 21, 2021. Specifically, Zinc Omadine PVC Industrial Fungicide (EPA Reg. No. 1258-1183) registered by Innovative Water Care, LLC was transferred from to Zinc Omadine PVC Industrial Fungicide (EPA Reg. No. 6836-463) registered by Arxada, LLC. At the time of the inspection, Intercide ZnP-5 DIDP Industrial Fungicide (EPA Reg. No. 1258-1183-1486) was cancelled, therefore making it unregistered. Pursuant to Section 3 of FIFRA, 7 U.S.C. ? 136a, pesticides that are sold or distributed in the United States are required to be registered with the EPA. Pursuant to Section 12(a)(1)(A) of FIFRA, 7 U.S.C. ? 136j(a)(1)(A), it is unlawful for any person in any State to distribute or sell to any person any pesticide that is not registered under section 3 or whose registration has been canceled or suspended, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA.
