Case summary

STOP SALE, USE, OR REMOVAL ORDER: 07/22/2026 The Respondent in this matter is Acro International Food Distributors, LLC, a limited liability company doing business in the State of Georgia (Respondent). On July 8, 2026, the EPA conducted an inspection at Respondent's facility located at 2689 Mountain Industrial Boulevard, Tucker, Georgia 30084 (Facility). During the inspection, Respondent stated that Sniper 1000EC DDVP and Sniper Flying Insect Killer were available for purchase. During the inspection, the inspector photographed containers of Sniper 1000EC DDVP and Sniper Flying Insect Killer, including their labels, as they were available for purchase at the Facility. Based on the preceding paragraphs, the inspector observed Sniper 1000EC DDVP and Sniper Flying Insect Killer being offered for sale by Respondent. A review of the Sniper 1000EC DDVP labels found the following claims: For the control of a wide range of insects... and A contact stomach acting and fumigant insecticide. Based on these claims, Sniper 1000EC DDVP is a substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest. Therefore, Sniper 1000EC DDVP is a pesticide requiring registration with the EPA pursuant to Section 3 of FIFRA prior to its distribution or sale. A review of the Sniper Flying Insect Killer label found the following claims: FLYING INSECT KILLER and Kills flies, mosquitoes and other flying insects. Based on these claims, Sniper Flying Insect Killer is a substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest. Therefore, Sniper Flying Insect Killer is a pesticide requiring registration with the EPA pursuant to Section 3 of FIFRA prior to its distribution or sale Sniper 1000EC DDVP and Sniper Flying Insect Killer are not pesticides registered with the EPA. Based on the facts detailed above, the EPA has reason to believe that Respondent's sale or distribution of the unregistered pesticides Sniper 1000EC DDVP and Sniper Flying Insect Killer constitutes an unlawful act in violation of Section 3 of FIFRA, 7 U.S.C. 136a, and Section 12(a)(1)(A) of FIFRA, 7 U.S.C. 136j(a)(1)(A), and that further sale or distribution of the unregistered pesticides in the United States, except in compliance with this SSURO and the requirements of FIFRA, would violate FIFRA. Pursuant to Section 13(a) of FIFRA, 7 U.S.C. 136k(a), Respondent is hereby ordered to STOP any further distribution, sale, offer for sale, use, or removal of all quantities of the unregistered pesticides identified in Section III of this SSURO that are owned, controlled, or in the custody of Respondent wherever located in the United States, or that may come into the possession of Respondent. Within ten (10) calendar days of receipt of this SSURO, Respondent shall submit to the EPA a written proposal describing how it plans to comply with this SSURO.
