Case summary

STOP SALE, USE, OR REMOVAL ORDER: 07/22/2026 The Respondent in this matter is Vine and Branches LLC d/b/a Taih Tropical African, an entity or individual doing business in the State of Georgia (Respondent). On July 8, 2026, the EPA conducted an inspection at Respondent's facility located at 669 Roswell Street NE, Marietta, Georgia 30060 (Facility). During the inspection, Respondent stated that Sniper 1000EC DDVP was available for purchase. During the inspection, the inspector photographed the Sniper 1000EC DDVP product, including its label, as it was available for purchase at the Facility. Based on the preceding paragraphs, the inspector observed Sniper 1000EC DDVP being offered for sale by Respondent. A review of the Sniper 1000EC DDVP label found the following claims: For the control of a wide range of insects... and A contact stomach acting and fumigant insecticide. Based on these claims, Sniper 1000EC DDVP is a substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest. Therefore, Sniper 1000EC DDVP is a pesticide requiring registration with the EPA pursuant to Section 3 of FIFRA prior to its distribution or sale. Sniper 1000EC DDVP is not a pesticide registered with the EPA. Based on the facts detailed above, the EPA has reason to believe that Respondent's sale or distribution of the unregistered pesticide Sniper 1000EC DDVP constitutes an unlawful act in violation of Section 3 of FIFRA, 7 U.S.C. 136a, and Section 12(a)(1)(A) of FIFRA, 7 U.S.C. 136j(a)(1)(A), and that further sale or distribution of the unregistered pesticide in the United States, except in compliance with this SSURO and the requirements of FIFRA, would violate FIFRA. Pursuant to Section 13(a) of FIFRA, 7 U.S.C. 136k(a), Respondent is hereby ordered to STOP any further distribution, sale, offer for sale, use, or removal of all quantities of the unregistered pesticide identified in Section III of this SSURO that are owned, controlled, or in the custody of Respondent wherever located in the United States, or that may come into the possession of Respondent. Within ten (10) calendar days of receipt of this SSURO, Respondent shall submit to the EPA a written proposal describing how it plans to comply with this SSURO.
