SEPTEMBER 8, 2026 - CONSENT AGREEMENT Respondent is required under 29 C.F.R. ?1910.1200(g) to prepare or have available an MSDS for hazardous chemicals under OSHA for Medium Density Fiberboard, Particleboard, Kent Ivory 8331 Hybrid, Black 9721 Polyester TGIC, and Sulfuric Acid. At some time during calendar years 2021, 2022, and 2023, Medium Density Fiberboard, Particleboard, Kent Ivory 8331 Hybrid, Black 9721 Polyester TGIC, and Sulfuric Acid were present at the Facility in an amount equal to or greater than 10,000 pounds or 500 pounds, respectively. Respondent failed to submit a completed Emergency and Hazardous Chemical Inventory Form for Medium Density Fiberboard, Particleboard, Kent Ivory 8331 Hybrid, Black 9721 Polyester TGIC, and Sulfuric Acid to the SERC, LEPC, and fire department with jurisdiction over the Facility for calendar years 2021, 2022, and 2023 by March 1 of the following calendar years. Respondent violated the reporting requirements of Section 312 of EPCRA by failing to submit the required Emergency and Hazardous Chemical Inventory Form for Medium Density Fiberboard, Particleboard, Kent Ivory 8331 Hybrid, Black 9721 Polyester TGIC, and Sulfuric Acid for calendar years 2021, 2022, and 2023 by March 1 of the following calendar years and is therefore subject to the assessment of penalties under Section 325 of EPCRA, 42 U.S.C.? 11045. Respondent agrees to a civil penalty in the amount of $26,474.00 ( Assessed Penalty ). Based on Respondent's documented ability to pay claim, and in accordance applicable laws, EPA conducted an analysis of Respondent's financial information and determined that the Assessed Penalty is an appropriate amount to settle this action, which Respondent consents to pay as follows: (a) The Assessed Penalty will be paid in 6 installments, in order to complete payment of the entire Assessed Penalty and interest, which is assessed at the IRS standard underpayment rate. Including the Assessed Penalty and interest, the total amount that will be paid upon completion of all payments will be $26,988.78. The first payment is due within thirty (30) calendar days after the Effective Date. Respondent's subsequent payments shall thereafter be due in 30-calendar-day intervals from said Effective Date.
