JULY 27, 2026 - CONSENT AGREEMENT Respondent is a person as defined in 40 C.F.R. ? 751.5, and a retailer as defined in 40 C.F.R.? 751.103. Respondent engages in the sale of detailing supplies and equipment to automotive dealerships, body shops, detailers, car washes, and consumers. On October 3, 2023, the EPA sent Respondent a combined Notice of Potential Violation and Information Request Letter pursuant to Section ll(c) of TSCA, 15 U.S.C. ? 2610(c), alleging that Respondent had potentially violated Section 15 of TSCA, 15 U.S.C. ? 2614, by failing to comply with the Methylene Chloride Rule at 40 C.F.R. Part 751, Subpart B. In the combined letter, the EPA also requested records related to assessing Respondent's compliance with the Methylene Chloride Rule and Section 15 of TSCA, 15 U.S.C. ? 2614. Respondent submitted responses to the combined letter on October 4, 2023. At the request of the EPA, Respondent submitted additional records to the EPA on September 7, 2024, November 24, 2024, December 5, 2024, and June 4, 2025. Distribution of Methylene Chloride Containing Products The records submitted by Respondent included sales records which revealed that between March 3, 2020, and September 26, 2023, Respondent distributed in commerce methylene chloride containing products for paint and coating removal a total of 18 times. Pursuant to 40 C.F.R. ? 751.l0S(c), after November 22, 2019, all retailers are prohibited from distributing in commerce methylene chloride containing products for paint and coating removal. Based on Respondent's substantiated ability to pay claim, Respondent consents to the payment of a civil penalty, which the EPA has determined to be an appropriate amount to settle this action, in the amount of TWO HUNDRED FIFTY DOLLARS ($250.00), within thirty {30) days of the Effective Date of this CAFO.
