EPA v. Suncoast Chemicals Company and Pinch A Penny

Case summary

On or around May 22, 2025, the EPA reviewed the Pinch A Penny website located at https://pinchapenny.com/ and various subpages of the Pinch A Penny website (collectively, ?the Website). During the review of the Website, the EPA observed that the pesticide product Suncoast Yellow Blast was being offered for sale on the Website, as a 21-ounce package, via an Add-to-Cart button. An article discussing the pesticide product titled ?How to Remove Yellow Mustard Algae from Your Pool? was observed on the Website making the following claims: ? The best way to get rid of yellow algae in a swimming pool is Suncoast Yellow Blast. ? When used in conjunction with Suncoast Gold Liquid Chlorinating Shock, Yellow Blast is the most effective method to quickly clear yellow algae and help prevent it from coming back. Page 2 of 4 ? Yellow Blast will control algae growth and maintain clear water when used as directed. ? Using Yellow Blast and chlorine together will give you much quicker results in removing yellow algae from your pool. On or around July 25, 2025, an authorized representative of the EPA conducted an inspection at the Suncoast Chemicals Company?s and Pinch A Penny?s facility, located at 6385 150th Avenue North, Clearwater, Florida 33760, to gather information about compliance with FIFRA. During the inspection, labels were collected for the pesticide product Suncoast Yellow Blast. Sales and distribution records provided after the inspection demonstrate that Suncoast Chemicals Company and Pinch A Penny sold Suncoast Yellow Blast on one or more occasions as of July 25, 2025. Based on the claims on the labeling associated with Suncoast Yellow Blast, the EPA determined that the product is a pesticide as defined under FIFRA Section 2(u), 7 U.S.C. ? 136(u) in that the product contained a substance or mixture of substances intended for preventing, destroying, repelling or mitigating any pest. Pursuant to FIFRA Section 3(a), 7 U.S.C. ? 136a(a), no person in any State may distribute or sell to any person any pesticide that is not registered under FIFRA, except as may be specified elsewhere under FIFRA. At the time of the inspection, Suncoast Yellow Blast was documented as having been sold or distributed without being registered as a pesticide with the EPA. As set forth in FIFRA Section 12(a)(1)(A), 7 U.S.C. ? 136j(a)(1)(A), it is unlawful to distribute or sell any pesticide that is not registered under FIFRA.
