FIFRA NOW: 9/12/2025 Phyllom Bioproducts Corporation Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) Case File No. FIFRA-04-2025-3532 The U.S. Environmental Protection Agency regulates the registration, distribution, sale and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Phyllom Bioproducts Corporation (hereinafter Phyllom Bioproducts), pursuant to Section 9(c)(3) of FIFRA, 7 U.S.C. 136g(c)(3) which provides the EPA with the authority to issue a NOW. The EPA finds that Phyllom Bioproducts violated FIFRA Section 12(a)(1)(E) by distributing or selling adulterated or misbranded pesticides. On or around May 28, 2025, Buckland Global Trade Services, the licensed customs broker for Phyllom Bioproducts, filed for entry using the U.S. Customs and Border Protection (CBP) Automated Commercial Environment (ACE) Data Processing System for the importation of the registered pesticide product, Phyllom SDS-5002 MP (EPA Reg. No. 88347-1) under entry number MU3-51348940 that arrived at the Port of Atlanta International Airport (Port Code 1704) on or around July 9, 2025. After a review of the entry and product label uploaded to DIS for Phyllom SDS-5002 MP (EPA Reg. No. 88347-1), the EPA determined the label did not match the most recently EPA-approved label from October 12, 2021, but more closely resembled the EPA-approved label from June 6, 2013, label. Pursuant to Section 2(q)(1)(A) of FIFRA, 7 U.S.C. 136(q)(1)(A), a pesticide is misbranded if its labeling bears any statement, design, or graphic representation relative thereto or to its ingredients which is false or misleading in any particular. By including a different name under the active ingredients and including the information under the Precaution Statement which isn't on the most recent EPA approved label the product appeared to be misbranded.
