FIFRA NOW: 9/11/2025 Premier Polymers, LLC FIFRA Notice of Warning Case File No. FIFRA-04-2025-3526 The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Premier Polymers, LLC (hereinafter Premier), pursuant to Section 14(a)(4) of FIFRA, 7 U.S.C. 136l(a)(4), which provides the EPA with the authority to issue a NOW. As explained below, the EPA finds that Premier violated FIFRA Section 12(a)(1)(E) by distributing or selling adulterated or misbranded pesticides. On August 28, 2024, an authorized representative of the EPA conducted an inspection at Premier to determine compliance with FIFRA. During the inspection, labels and sales and distribution records were collected for Premiercide 260 (EPA Reg. No. 67071-18-92545) and TMB 471C (EPA Reg. No. 63269-6). Sales and distribution records collected during the inspection demonstrate that Premier sold Premiercide 260 (EPA Reg. No. 67071-18-92545) on one or more occasions between June and August 2024. A review of the Premiercide 260 pesticide product label was conducted and it was found that the label contains the statement under the Directions for Use, which are classified as indoor non-food and non-food applications under the Directions for Use which is not on any of the recent EPA-approved labels. Pursuant to Section 2(q)(1)(F) of FIFRA, 7 U.S.C. 136(q)(1)(F), a pesticide is misbranded if the labeling accompanying it does not contain all directions for use which that are necessary for effecting the purpose for which the product is intended and that, if complied with, together with any requirements imposed under Section 3(d) of the Act FIFRA, 7 U.S.C. 136a(d), are adequate to protect health and the environment. At the time of the inspection, the label on the pesticide failed to bear an adequate Directions for Use, therefore the product is misbranded.
