Unilateral Administrative Order Without Adjudication

Case summary

FIFRA NOW: 12/11/2024 Sevenports, LLC dba Aquarium Life Support Systems FIFRA Notice of Warning Case File No. FIFRA-04-2025-3503 The U.S. Environmental Protection Agency has obtained evidence indicating that Sevenports, LLC doing business as Aquarium Life Support Systems (herein Sevenports) appears to be in violation of, or have committed a violation of, the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). On or around November 14, 2024, the EPA reviewed the Sevenports websites (www.sevenports.com and www.aqualifesupport.com). During the reviews, it was found that the product AZOO Triple Black Water, 120 mL was being offered for sale while making the following claims: ?Inhibits pathogen growth and greatly boost fish?s immunity against diseases.? ?Promotes growth of aqua plants and reduces growth of algae.? Based on the claims on the label, the EPA determined that the product is a pesticide as defined under FIFRA Section 2(u), 7 U.S.C. ? 136(u) in that the product contained a substance or mixture of substances intended for preventing, destroying, repelling or mitigating any pest and the product contained a substance or mixture of substances intended for use as a plant regulator, defoliant, or desiccant. Based on a review of EPA records, it does not appear that AZOO Triple Black Water is a pesticide that has been registered with the EPA. Pursuant to FIFRA Section 3(a), 7 U.S.C. ? 136a(a), no person in any State may distribute or sell to any person any pesticide that is not registered under FIFRA, except as may be specified elsewhere under FIFRA. At this time, AZOO PLUS Triple Black Water is documented as being sold or advertised for sale without being registered as a pesticide with the EPA and with no evidence to support that the sale or distribution had occurred through an exception defined under FIFRA that would allow for the sale or distribution of an unregistered pesticide. As set forth in FIFRA Section 12(a)(1)(A), 7 U.S.C. ? 136j(a)(1)(A), it is unlawful to distribute or sell any pesticide that is not registered under FIFRA Section 3, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA.
