FIFRA NOW: 1/22/2025 Zinpro Specialty Products, LLC FIFRA Notice of Warning Case File No. FIFRA-04-2025-3502 The U.S. Environmental Protection Agency has obtained evidence indicating that Zinpro Specialty Products, LLC (hereafter Zinpro), may be in violation of, or have committed violations of, the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). On or around April 10, 2024, the EPA conducted an inspection at Zinpro (EPA Est. No. 85684-AL-1), located at 411 Ranch Road, Rainsville, Alabama 35986. During the inspection, bin labels and sales records were collected for Traffic C.O.P. and Cool-N-Klean. The sales records for Traffic C.O.P. and Cool-N-Klean, indicate that they were sold or distributed on one or more occasions between January and April 2024. Pursuant to Section 3 of FIFRA, 7 U.S.C. ? 136a, pesticides that are sold or distributed in the United States are required to be registered with the EPA. Pursuant to Section 12(a)(1)(A) of FIFRA, 7 U.S.C. ? 136j(a)(1)(A), it is unlawful for any person to distribute or sell to any person any pesticide that is not registered under Section 3 of FIFRA, 7 U.S.C. ? 136a. The term ?antimicrobial pesticide? is defined in Section 2(mm) of FIFRA, 7 U.S.C. ? 136(mm), to mean a pesticide that is intended to disinfect, sanitize, reduce, or mitigate growth or development of microbiological organisms. Therefore, the EPA alleges that by failing to file the annual report, Zinpro violated Section 12(a)(2)(N) of FIFRA. Pursuant to Section 12(a)(2)(N) of FIFRA, it is unlawful for a producer to violate Section 7(a) of the Act. As set forth in Section 7(c), 7 U.S.C. ? 136e(c), Information Required (1) Any producer operating an establishment registered under this section shall inform the Administrator within 30 days after it is registered of the types and amounts of pesticides and, if applicable, active ingredients used in producing pesticides ? (A) which the producer is currently producing; (B) which the producer has produced during the past year; and (C) which the producer has sold or distributed during the past year. The information required by this paragraph shall be kept current and submitted to the Administrator annually as required under such regulations as the Administrator may prescribe.
