STOP SALE, USE, OR REMOVAL ORDER: 10/05/2026 This Stop Sale, Use, or Removal Order (SSURO or Order) is issued to Environmental Manufacturing Solutions, L.L.C. and EMS Distribution, Environmental Manufacturing Solutions, L.L.C. (collectively, Respondents) pursuant to the authority vested in the Administrator of the U.S. Environmental Protection Agency (EPA or the Agency) by Section 13(a) of the Federal Insecticide, Fungicide, and Rodenticide Act, as amended (FIFRA or the Act), 7 U.S.C. 136k(a), which authorizes the Administrator of the EPA to issue an order prohibiting the sale, use, or removal of any pesticide or device by any person who owns, controls, or has custody of such pesticide or device whenever there is reason to believe that such pesticide or device is in violation of any provision of FIFRA, or the pesticide or device has been, or is intended to be, distributed or sold in violation of any provision of FIFRA. Respondents are Environmental Manufacturing Solutions, L.L.C. (EMS), a Florida limited liability company with its principal place of business located at 7705 Progress Circle, Melbourne, Florida 32904 (the Facility), and EMS Distribution, Environmental Manufacturing Solutions, L.L.C. (EMS Distribution), a Florida limited liability company with its principal place of business also located at the Facility. The Facility is registered with the EPA as an establishment under FIFRA and has been assigned the Establishment Number 82859-FL-1 with the establishment name ENVIRONMENTAL MFG SOLUTIONS LLC. Respondents are persons as defined in Section 2(s) of FIFRA, 7 U.S.C. 136(s). Respondents produce and/or distribute the unregistered pesticide, Purgo, also known as Purgo Antimicrobial Multi-Surface Cleaner, which Respondent EMS represents to be exempt from pesticide registration requirements under FIFRA as a minimum risk pesticide. Respondents also produce and/or distribute the pesticide, Purgo N, which is registered with the EPA as a pesticide for use as a disinfectant and sanitizer (EPA Registration Number 82859-2). Pursuant to Section 13(a) of FIFRA, 7 U.S.C. 136k(a), Respondents are hereby ordered to STOP any further distribution, sale, offer for sale, use, or removal of all quantities and inventory of the unregistered pesticide, Purgo, referenced in Section III of this SSURO, that are owned, controlled, or in the custody of Respondents wherever located in the United States, or that may come into the possession of Respondents. Respondents shall undertake all actions required by this SSURO and comply with all requirements of this SSURO. Within ten (10) days, Respondents shall submit to the EPA a written proposal describing how Respondents plan to comply with the requirements of this SSURO.
