JUNE 4, 2026 - CONSENT AGREEMENT Respondent failed to submit a Form R for Chlorine and Lead Compounds to EPA and to the State of Georgia for calendar years 2022 and 2023 by July 1, 2023, and July 1, 2024, respectively. Respondent is a person″ and is the owner and operator of the Facility which is a ?facility,? as those terms are defined in Section 329(7) of EPCRA, 42 U.S.C. ? 11049(7), and Section 329(4) of EPCRA, 42 U.S.C. ? 11049(4), during the relevant period described herein. Respondent violated the reporting requirements of Section 313 of EPCRA by failing to submit the required Form R for Chlorine and Lead Compounds for calendar years 2022 and 2023 by July 1, 2023 and July 1, 2024, respectively and is therefore subject to the assessment of penalties under Section 325 of EPCRA, 42 U.S.C. ? 11045. Respondent agrees to a civil penalty in the amount of $47,145.70 (?Assessed Penalty?), to be paid within thirty (30) calendar days after the Effective Date of this CAFO.
