DECEMBER 2, 2024 - ADMINISTRATIVE ORDER ON CONSENT 1On October 10, 2023, the EPA and MDEQ conducted a Compliance Evaluation Inspection (CEI) to assess the overall operation of the Facility. The CEI identified violations of the Operations and Maintenance Requirements Section of the 2019 NPDES Permit. The EPA's finding and recommendations were summarized in a CEI Report dated November 20, 2023. In May 2024, the EPA reviewed its Integrated Compliance Information System (ICIS). The review identified violations of the Effluent Limits and Monitoring Requirements Section of the 2019 NPDES Permit. Specifically, the County violated the effluent limitations for 5-day Biochemical Oxygen Demand (5 counts), Total Suspended Solids (3 counts), Flow (2 count ), and E.coli (8 counts) as indicated in the discharge monitoring reports (DMRs) during the period covering January 1, 2020, through April 30, 2024. On July 2, 2024, the EPA sent a Notice of Violations (NOV) to the City regarding violations identified during the CEI and ICIS review. The NOV noted Effluent Limitation and Monitoring violations and Proper Operation and Maintenance violations of the 2019 NPDES Permit. Based on the above, the EPA finds that the City is in violation of Section 301(a) of the CWA, 33 U.S.C. ? 1311(a}, and the above referenced provisions of its 2019 NPDES Permit. Bc:sed on the foregoing EPA FINDINGS and pursuant to the authority of Section 309{a) of the CWA, 33 U.S.C. ? 1319(a), IT IS HEREBY ORDERED AND AGREED TO that the City comply with the following requirements. For the existing Facility to achieve compliance with its NPDES Permit, the City shall, within 120-days of the effective date of this Order on Consent, develop and submit to the EPA for review and approval the plans described in more detail below. The goal of these plans is to correct the violations alleged above and to bring the City into full compliance with its NPDES Permit. Upon review of each plan, the EPA may: (1) approve the plan in writing; or (2) in the event the plan is not approved, provide written comments to the City identifying any deficiencies. Within 30-days of the date of receipt of comments identifying deficiencies, the City shall modify the plan to address the identified deficiencies and resubmit the plan to the EPA for final review and approval. Should the EPA determine that the City has failed to resolve any deficiencies, the EPA reserves the right to require additional revisions and resubmissions until the deficiencies are satisfactorily addressed. Resubmission of the plan without adequately addressi1g the EPA's comments may be deemed a violation of this Order on Consent. The City shall begin implementation of the plans immediately upon receipt of the EPA's written approval of the plans.
