APRIL 17, 2023 - NOTICE OF REFUSAL OF ADMISSION FIFRA ? 12(a)(1)(A) To sell or distribute to any person any pesticide that is not registered under Section 3 or whose registration has been cancelled or suspended, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA. Pesticide products entering under the provisions promulgated by 40 CFR 152.30(c)(2), whereby an unregistered pesticide may be distributed or sold without an EUP in accordance with part 40 CFR part 172.3, must be labeled in accordance with part 156 of this chapter. The pesticide products in this shipment do not appear to be labeled according to 40 CFR 156.10. Specifically, the labels include directions for use to be formulated into products for export. In addition, the label contains the following false or misleading statement: ?It is a violation of Federal Law to use this product in a manner inconsistent with its labeling.?
