MARCH 24, 2023 - NOTICE OF REFUSAL OF ADMISSION FIFRA 12(a)(1)(A) To sell or distribute to any person any pesticide that is not registered under Section 3 or whose registration has been cancelled or suspended, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA. Specifically, pesticide products entering under the provisions promulgated by 40 CFR 152.30(c)(2), whereby an unregistered pesticide may be distributed or sold without an EUP in accordance with part 40 CFR part 172.3, must be labeled in accordance with part 156 of this chapter. The pesticide products in this shipment do not appear to be labeled according to 40 CFR 156.10. Specifically, the labels are missing the container's net contents pursuant to 40 CFR 156.10(a)(1)(iii) and do not list product's inert ingredients as a percentage by weight pursuant to 40 CFR 156.10(a)(1)(iv).
