Case summary

JUNE 13, 2025 - CONSENT DECREE - The PPC Remedial Action settlement will address Operable Units (OU) 1, 2, and 3 (Interim) through implementing excavation, In-situ Solidification and Stabilization (ISS), and limited groundwater recovery and monitoring. This work will proceed following the demolition of multiple onsite small-bay warehouse buildings that were built over two former process waste disposal pits dating back to the 1950s. The PPC remedy will solidify and immobilize the site soil/sludge contamination and effectively eliminate this contamination from acting as a source to groundwater. The setting parties include both private and state/federal governmental entities, with a significant portion of the remedial action funding coming from the State of Florida Inland Protection Trust Fund (IPTF) related to it Early Detection Incentive (EDI) petroleum programs. The Remedial Action Consent Decree in this matter was entered by the U.S. District Court for the Southern District of Florida, Miami Division, on June 13, 2025. MARCH 6, 2024 - CERCLA Sections 106 and 107 Consent Decree for RA Petroleum Products Corporation Superfund Site SSID=04HS Operable Unit 1/Operable Unit 2/Operable Unit 3 (Interim) Pembroke Park, Broward County, Florida The Remedial Action (RA) Consent Decree covers the remaining OU1/OU2/OU3 free product (OU1), process waste sludge/soil (OU2), and groundwater cleanup activities (OU3) based on a comprehensive source cleanup workplan involving excavation, in-situ stabilization/stabilization (ISS), and limited groundwater treatment of historical contamination at the PPC Site. The PRPs collectively sent over 15,000,000 gallons of used oil/fluids to the PPC facility for recycling/re-refining from the late 1950s to 1987, and involved both private and public settling parties. The settlement will involve relocation of impacted business tenants, warehouse demolitions, and cleanup funding provided by State of Florida petroleum programs. Prior to this settlement in December 2022, four settling parties signed and implemented the Remedial Design through an Administrative Settlement Agreement and Order on Consent (ASAOC).
