SEPTEMBER 8, 2022 - NOTICE OF REFUSAL OF ADMISSION FIFRA ? 12(a)(1)(A): To sell or distribute to any person any pesticide that is not registered under Section 3 or whose registration has been cancelled or suspended, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA. Specifically, when a registered pesticide (i.e. BG-Sweetscent) is packaged and sold together with a device, the entire unit needs to be registered and the label on the product should represent the EPA-approved Master Label for the registered product. ? FIFRA ? 12(a)(1)(E): To sell or distribute a pesticide that is misbranded. Specifically, the product website ?www.biogents.com?, which is considered labeling, includes claims about the product such as ?non-toxic and eco-friendly?, ?our mosquito traps do not use any insecticides or other chemicals? and ?Not only safe for pets and children?.
