The device does not appear to be labeled in accordance with FIFRA 2(q)(1) in that its labeling bears any statement, design, or graphic representation relative thereto or to its ingredients which is false or misleading in any particular. Specifically, the label contains the statement ?Eliminate and remove pollutants including dust, fumes, fungus, pollen, and other microscopic airborne particles which is considered false or misleading because it is overly broad and does not specify the pests which the device is tested against. Additionally, the product label does not include the establishment number for the facility where it was produced.
