OCTOBER 20, 2021 - NOTICE OF REFUSAL OF ADMISSION FIFRA 12(a)(1)(A) To sell or distribute to any person any pesticide that is not registered under Section 3 or whose registration has been cancelled or suspended, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA. Specifically, the unregistered research and development pesticide products are not labeled in accordance with 40 CFR Part 156 in that the producing establishment number is not displayed on the label. Unregistered pesticides attempting to be distributed or sold in accordance with the provisions of 40 CFR part 172.3, pertaining to use of a pesticide for which an experimental use permit is not required, must be labeled in accordance with 40 CFR part 156.
