OCTOBER 12, 2021 - NOTICE OF REFUSAL OF ADMISSION FIFRA 12(a)(1)(F) To sell or distribute a pesticide device that is misbranded. Specifically, the device(s) do not appear to be labeled in accordance with FIFRA Section 2(q)(1). Devices must be produced in an EPA Registered Establishment and the EPA Establishment number for where production last occurred must appear on the product label along with the name and address of the company. Device labels must also include adequate directions for use and warning or caution statement. The product labeling does not appear to have directions for use or the EPA Establishment Number of the EPA-registered establishment where it was last produced. Additionally, the product label appears to include claims that are false or misleading in relation to the efficacy of the product. Please note that the terms sanitize, disinfect and sterilize have separate meanings under FIFRA regarding a products effectiveness as a pesticide or device.
