JULY 5, 2022 - NOTICE OF WARNING At the time of the inspection, the pesticide devices appeared to include a false or misleading claim. False and misleading claims included but were not limited to, ?Use no chemicals, talc, baits or pesticides. Pursuant to Section 2(q)(1)(A) of FIFRA, 7 U.S.C.136(q)(1)(A), a pesticide is misbranded if its labeling bears any statement, design, or graphic representation relative thereto or to its ingredients which is false or misleading in any particular. As set forth in Section 12(a)(1)(F) of FIFRA, 7 U.S.C. 36(j)(1)(F), it is unlawful for any person in any State to distribute or sell to any person any pesticide device which is misbranded. In response to the potential violation of FIFRA at the facility, the EPA is issuing this Notice of Warning (NOW) to K9King, LLC pursuant to FIFRA Section 9(c)(3), 7 U.S.C. 136g(c)(3).
