NOVEMBER 1, 2022 - ADMINISTRATIVE ORDER On January 31, 2022, EPA inspectors, accompanied by an MDEQ inspector, conducted a compliance evaluation inspection (CEI) of the WWTP and determined that the Town of Lyon was not properly operating and maintaining its WWTP. Conditions at the WWTP included extensive vegetative growth, improper chlorination, and improperly contained treatment chemicals, all of which reflect a failure on the part of the Town to properly operate and maintain the WWTP. On June 8, 2022, the EPA sent the Town a 308 Information Request letter requesting lab reports from the Town for the years 2019, 2020, and 2021. The Town was given thirty (30) days to send this information to the EPA. On July 8, 2022, 30 days after the 308 Information Request letter was sent, the Town had not sent the requested information to the EPA. On July 14, 2022, the plant operator notified EPA via email that he would provide the requested information on Monday, July 18, 2022. However, the required information has not been submitted to EPA. The Town violated Section 402 of the CWA, 33 U.S.C. ? 1342, by failing to properly operate and maintain its WWTP as required by Section T-28 of its Permit. The Town violated Section 308 of the CWA, 33 U.S.C. ? 1318, by failing to provide effluent monitoring data when requested by the EPA.
