DECEMBER 9. 2024 - COMPLAINT FILED WITH THE COURTS SEPTEMBER 8, 2021 - REFFERAL FOR LITIGATION DIESEL PERFORMANCE PARTS, (DPPI) NASHVILLE, TENNESSEE. JUNE 30, 2025 - CONSENT DECREE This CD addresses mobile source violations of the Act, in which the Defendant sold and offered to sell at least 6,858 aftermarket defeat devices at the Defendant?s facility located in Nashville, Tennessee (Facility) that bypassed, defeated or rendered inoperative emissions control systems that were installed in motor vehicles or in motor vehicle engines in compliance with the CAA for motor vehicles equipped with diesel engines. Pursuant to the terms of the CD, Defendant will pay $320,000 in civil penalties in four installments over three years, with the first payment of $80,000 due within 30 days of the effective date. DPPI will also be subject to a number of compliance requirements including, but not limited to, stop manufacturing, selling, offering for sale or installing any defeat device products; destroy any remaining inventory of illegal defeat device products; send notice(s) to dealers and customers notifying them about the settlement and the illegal products; revise market material that pertains to deleting, overwriting, bypassing or rendering inoperative any emission control device or emissions-related element of design; and conduct CAA compliance training for all officers, employees, contractors, and consultants with responsibilities for sales, and marketing, distribution of aftermarket parts for motor vehicles.
