Case summary

20210401 - ADMINISTRATIVE COMPLIANCE ORDER ON CONSENT ISSUED. ALLEGED VIOLATIONS: On July 23: 202(i, the EPA-issued a Notice of Potential Noncompliance (NOPNC) to Respondent, pursuant to Section 1414(a)(l)(A) of the SDWA, 42 U.S.C. ? 300g-3(a)(l)(A), to allow Respondent time to review the potential noncompliance and schedule a show-cause meeting to discuss their compliance status. On July 28, 2020, Respondent requested a show-cause meeting. On August 3, 2020, the EPA held a show-cause meeting with Respondent to discuss potential noncompliance. The EPA requested a narrative response explaining the System's attempts to comply with the SDWA and NPDWRs, including supporting documentation, and that it be submitted to the EPA by August 14, 2020. This response was received on August 13, 2020. On August24, 2020, the EPA requested additional information from Respondent to be submitted by August 31, 2020. This response was received on September 3, 2020. Upon the EPA's review of violations listed in the Safe Drinking Water Information System Federal Reporting Services (SDWIS), and documentation submitted by Respondent and TDEC, the EPA determined that Respondent is in noncompliance with the SDWA and the NPDWRS. By failing to follow the reduced monitoring schedule, Respondent became ineligible for reduced monitoring and needed to comply with the standard monitoring schedule, which required the collection of samples at twenty (20) sites. On the standard monitoring schedule, Respondent was also required to sample during two consecutive monitoring periods (January 1, 2019 - June 30, 2019 and between July 1, 2019 - December 31, 2019). No samples were collected during the January 1, 2019 - June 30, 2019 monitoring period. Twenty (20) samples were collected from August 18, 2019 to October 11, 2019; however, no other samples have been collected. Therefore, Respondent is in noncompliance with 40 CFR Section 141.86(a)-(d). Based on the findings above, the EPA has determined that the System has numerous SDW violations, including violations of the NPDWRs.
