SEPTEMBER 14, 2021 - Administrative Order on Consent under Section 7003 of RCRA: The EPA has determined that there may be an imminent and substantial endangerment to human health and the environment as a result of the past or present handling, storage, treatment, transportation, or disposal of solid and/or hazardous wastes at Respondent?s facility located at 525 Plainview Street, Gadsden, Alabama (the Facility). The enclosed Order states the reasons for this determination and directs Respondent to take steps to abate this endangerment. Compliance with this Order is required. Violation of the Order or the failure or refusal to comply with any of the requirements of the Order may result in the EPA seeking enforcement of the Order in the United States District Court for the Northern District of Alabama. In such an action, the EPA Would request that the Court enforce compliance with the Order and assess a civil penalty of up to $15,352 for each day in which such a violation occurred or is occurring and for each day where there was or is a failure or refusal to comply. See 42 U.S.C. ? 6973(b). The public comment period for this Order began on August 27, 2021 and concluded on September 10, 2021. During this public comment period, the EPA did not receive any comments related to the Order. The Order was signed by the EPA and became effective on September 14, 2021. This date will be used to determine the date of future deliverables.
