JUNE 4, 2021 - NOTICE OF REFUSAL OF ADMISSION FIFRA 12(a)(1)(E) To sell or distribute a pesticide that is misbranded. Specifically, the importer asserts that the pesticide product is accompanied by a label which does not state the EPA establishment number, the EPA product registration number, or the net contents. Pursuant to 40 CFR 156.10(a)(iii) through (v), every pesticide product shall bear a label containing the information specified by FIFRA and the regulations in this part. The contents of a label must show clearly and prominently the net contents as prescribed in paragraph (d) of this section, the product registration number as prescribed in paragraph (e) of this section, and the producing establishment number as prescribed in paragraph (f) of this section.
