Specifically, the pesticide product does not appear to have met the conditions of 40 CFR 152.132 for supplemental distribution in part because the distributor product does not appear to have been manufactured and packaged by the same party that manufactures and packages the registered basic product. ? FIFRA 12(a)(1)(E) To sell or distribute a pesticide that is misbranded. Based on the images and documents provided by Textiles Coated International, the pesticide product?s distributor labeling affixed to the product is not in compliance with the requirements placed on the registrant?s basic product. ? FIFRA 12(a)(2)(N) Failure to file reports required by the Act. The importer or the importer's agent did not file or did not complete: o A Notice of Arrival of Pesticide and Devices (NOA) EPA Form 3540-1 prior to the arrival of the shipment in the U.S. or; o An electronic alternative to the NOA filed with the entry documentation via any U.S. Customs and Border Protection (CBP) authorized electronic data interchange system.
