Case summary
12/17/2020 - CAFO ISSUED. Based on the EPA' s review of the Respondent's records during the December 11, 2019, inspection, the EPA has determined that prior to offering and entering into a contract for lease of residential dwelling of target housing, the Respondent failed to: a. Provide the lessee with the EPA-approved lead hazard information pamphlet in violation of 40 C.F.R. ? 745.107(a)(l); b. Include as an attachment or within the contract to lease target housing, the appropriate Lead Warning Statement, in violation of 40 C.F.R. ? 745.1 B(b )(1 ); c. Include as an attachment or within the contract to lease target housing a statement by the lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards in the target housing being leased or indicating no knowledge of the presence of leadbased paint and/or lead-based paint hazards in violation of 40 C.F.R. ? 745.113(b )(2); d. Include as an attachment or within the contract to lease target housing a statement by the agent involved in the transaction to lease target housing that the agent has informed the lessor of the lessor's obligations, and that the agent is aware of his their duty to ensure compliance in violation of 40 C.F.R. ? 745.1 l 3(b )(5), as promulgated at 61 Federal Register 9085 (March 6, 1996); and e. Include as an attachment or within the contract to lease target housing the signatures of the lessors, agents, and lessees, certifying to the accuracy of their statements, to the best of their knowledge, along with the dates of signature in violation of 40 C.F .R. ? 745.113(b)(6). Based on the Respondent's substantiated ability to pay claim, and in accordance with the Act, the EPA has determined that SIX-THOUSAND, TWO-HUNDRED DOLLARS ($6,200), is an appropriate civil penalty to settle this action, which Respondent consents to pay as follows: a. The civil penalty will be paid in two equal installments in order to complete payment of the entire civil penalty including interest. Including the civil penalty and interest, the total amount that will be paid upon completion of all payments will be SIX-THOUSAND, TWO-HUNDRED, FORTY-SIX DOLLARS AND FORTY-TWO CENTS. ($6,246.42). The first payment is due within ninety (90) days of the Effective Date of this CAFO, which is the date that the CAFO is filed by the Regional Hearing Clerk. The second payment is due within 180 days after the Effective Date of the CAFO.
