9/29/2020 - COST RECOVERY AGREEMENT: Settling Party shall pay to EPA Incident Response Costs of $150,000. The payment shall be made within 30 days after the Effective Date and, if timely paid, shall inc lude no Interes t. Alternative ly, payment of the principal amount sha ll be made in four installments. The first installment payme nt of $37 ,500 is due within 30 days after the Effective Date and, if timely pa id, shall include no Interest. The subseq uent ins tallment payments of $37,500 each are due every six-months following the Effective Date. Each installment payment shall also inc lude an additional sum for Interest accrued on the unpaid portion of the principal amo unt calculated from the date of the prior payment until the date of payment. EPA shall send a calcu lation of the Interest due for each payment to Se ttlin g Party after the Effective Date. Settl ing Party may pay any installment payment prior to the due date , but must U.S. Environmental Protection Agency Region 4 Superfund & Emergency Management Division, Enforcement Branch, in advance for a determination regarding the amount ofl nterest to be included with the payment. 1n the eve nt any installment payment includes an overpayment, the amount of the overpayment sha ll be applied to the remaining principal. Deposit of Payment. The total amount of each payment to be paid pursuant to Paragraph 12 (Payment of Response Costs) shall be deposited by EPA in the EPA Hazardous Substance Superfund.
