20201112 - CONSENT AGREEMENT AND FINAL ORDER ISSUED, ASSESSING A TOTAL PENALTY OF $54,696. RESPONDENT SHALL MAKE PAYMENT WITHIN 30 DAYS. ALLEGED VIOLATIONS: At some time during calendar year 2018, Magnesium Sulfate, Magnesium Oxide, and Fragrance were present at the Facility in an amount equal to or greater than 10,000 pounds, and Sulfuric Acid was present at the Facility in an amount equal to or greater than 500 pounds. Respondent failed to submit a completed Emergency and Hazardous Chemical Inventory Form for Magnesium Sulfate, Magnesium Oxide, Fragrance, and Sulfuric Acid to the SERC, LEPC, and fire department with jurisdiction over the Facility for calendar year 2018 by March 1 of the following calendar year. Respondent violated the reporting requirements of Section 312 of EPCRA by failing to submit the required Emergency and Hazardous Chemical Inventory Form for Magnesium Sulfate, Magnesium Oxide, Fragrance, and Sulfuric Acid for calendar year 2018 by March 1, 2019, and is therefore subject to the assessment of penalties under Section 325 of EPCRA, 42 U.S.C. ? 11045.
