THE CAP FEAR RIVER IS A TRADITIONALLY NAVIGABLE WATER OF THE U.S. THIS DISCHARGE OCCURRED WHILE THE FACILITY WAS IN VIOLATION OF HTE PERMIT. THEREFORE, RESPONDENT HAS VIOLATED CWA 301.
