3/17/2014 - NOTICE OF DETERMINATION ISSUED. IN A MARCH 24, 2009, LETTER TO EPA, RESPONDENT DISCLOSED POTENTIAL VIOLATIONS OF CWA, EPCRA, RCRA, AND TSCA. THE DISCLOSURES DETERMINED BY THE EPA TO BE VIOLATIONS WERE CORRECTED BY AUGUST 29, 2009, FOLLOWING EPA-APPROVED EXTENSTIONS. PURSUANT TO THE AUDIT POLICY, AND BASED ON INFORMATION PROVIDED BY RESPONDENT, THE EPA MAKES THE FOLLOWING FINAL DETERMINATION FOR THE FEDERALLY ENFORCEABLEE VIOLATIONS. THE RESPONDENT DID VIOLATE THE REGULATIONS; HOWEVER, THE SELF-DISCLOSURE MET THE CONDITIONS OF THE AUDIT POLICY FOR 100 PERCENT ELIMINATION OF THE GRAVITY-BASED PENALTIES FOR THESE VIOLATIONS. THUS, THE EPA WILL NOT SEEK GRAVITY-BASED PENALTIES FOR THESE VIOLATIONS. IN ADDITION, FOR PURPOSES OF THIS DISCLOSURE, THE EPA WILL NOT SEEK THE ECONOMIC BENEFIT PORTION OF THE PENALTIES.
