7/29/2009 - NOTICE OF DETERMINATION ISSUED. RESPONDENT DISCOVERED THE VIOLATIONS ON FEBRUARY 7, 2008, UPON RECEIPT OF A PEER AUDIT REPORT. RESPONDENT DISCLOSED THE VIOLATIONS TO EPA ON FEBRUARY 28, 2008. ALL BUT FOUR OF THE 73 VIOLATIONS DISCLOSED WERE CORRECTED BY APRIL 28, 2008. RESPONDENT OBTAINED AN EXTENSION FROM EPA TO COMPLETE CORRECTIVE ACTION FOR THE FOUR VIOLATIONS (CAA, CWA, RCRA & TSCA). THE FOUR VIOLATIONS WERE CORRECTED BY MAY 23, 2008. THE VIOLATIONS DESCRIBED IN THE ATTACHMENT TO THE NOD. NONE OF THE VIOLATIONS DISCOVERED ARE REPEAT VIOLATIONS.
