9/24/09 - NOTICE OF DETERMINATION ISSUED. IN A FINAL COMPLIANCE REPORT TO EPA DATED JUNE 27, 2008, FLAGLER DISCLOSED THE VIOLATIONS. THE VIOLATIONS WERE DISCOVERED ON JAN 18, 2008, THRU A SELF-ASSESSMENT AND DISCLOSED ON FEB 8, 2008. ALL VIOLATIONS WERE CORRECTED BY APR 8, 2008. NONE OF THE VIOLATIONS DISCOVERED ARE REPEAT VIOLATIONS. ADDITIONALLY, NONE RESULTED IN SERIOUS HARMS NOR DID THEY PRESENT AN IMMINENT AND SUBSTANTIAL ENDANGERMENT. FLAGLER HAS TAKEN STEPS TO PREVENT RECURRENCE OF THE VIOLATIONS AND HAS COOPERATED WITH EPA.
