Case summary

1/27/11 - STIPULATION OF SETTLEMENT ENTERED. EPA and the Commonwealth of Kentucky alleged that Hydro Aluminum North America (Hydro) had violated section 112 of the Clean Air Act, 42 U.S.C. § 7412, the regulations promulgated thereunder at 40 C.F.R. Part 63, Subparts A and RRR (National Emission Standards for Hazardous Air Pollutants) pertaining to secondary aluminum production, and related provisions of laws and regulations of the Commonwealth at Hydro Aluminum’s secondary aluminum production facility in Henderson, Kentucky. EPA, the Commonwealth and Hydro reach a settlement of all claims requiring Hydro to pay a civil penalty of $283,500. On January 27, 2011, the U.S. District Court approved a Stipulation of Settlement between the parties, and Hydro has paid the penalty. Prior to entering the Stipulation of Settlement, Hydro had corrected the violations cited by EPA and the Commonwealth.
