ORDER ALLEGES: ON APRIL 28, 2005, RESPONDENT DISCHARGED 8,500 GALLONS OF OIL FROM ITS FACILITY ONTO AN EMBANKMENT OFF GEORGIA INTERSTATE HIGHWAY 75 INTO OR UPON THE HIAWASSEE RIVER WHICH CAUSED A SHEEN UPON OR DISCOLORATION OF THE SURFACE OF THE HIAWASSEE RIVER, AND A COMPLETE FISH KILL IN THE FIRST MILE DOWNSTREAM FROM THE SPILL LOCATION AND, THERE, WAS IN A QUANTITY THAT HAS BEEN DETERMINED MAY BE HARMFUL. IN VIOLATION OF CWA SECTION 311(b).
