Case summary

CAFO issued 11/23/2004, assessing a penalty of $7,821 for EPCRA violations; and $7,741 for the CERCLA violation. Respondent also agrees to complete a SEP. Respondent failed to submit Form Rs or Form As for calendar year 1999 for ammonia to the Administrator of EPA and to an official or officials of the State designated by the Governor. In violation of EPCRA section 313. Respondent failed to immediately report the release of anhydrous ammonia to the SERC aafter it had knowledge that an RQ of a hazardous substance was released. In violation of EPCRA section 304(a). Respondent failed to immediately notify the NRC as soon as Respondent had knowledge of the releases of anydrous ammonia in an amount equal to or greater than its RQ at Respondent's facility. In violation of CERCLA section 103(a).
