Respondent violated Part VI.D and Part VI.N of the Permit at the Facility by failing to design and implement erosion and sediment controls to retain sediments on-site; by failing to prevent discharges from the Facility which have a reasonable likelihood of having an adverse impact on either human health or the environment; by failing to maintain structural practices, specifically, storm drain inlet protection, sediment traps, and silt fencing to divert flows from exposed areas, store flows, or limit runoff and discharge of pollutants from exposed areas of the Facility; by failing to design, install, and maintain storm water measures at the Facility, specifically, sedimentation pond maintenance, storm drain outlet design and protection, and rock inlet/outlet protection, to control pollutants in storm water discharges; by failing to operate and maintain all systems of treatment and control (and related appurtenances) which are installed or used by the Respondent at the Facility to achieve compliance with the conditions of the permit and the requirements of the SWPP. Respondents violated Part IV.D.2b(2) of the Permit by failing to place velocity dissipation devices at discharge locations at the Facility.
