Case summary
CAFO issued 2/11/2004, assessing a penalty of $38,720. Respondent's establishment was not registered with the Administrator of EPA as a pesticide-producing establishment. Respondent distributed or sold misbranded pesticides, Aurora HBV, pHD Germicidal Detergent & Deodorant, NeutraQuat Germicidal & Deordorant, and Tri-Phene Cleaner Disinfectant Deodorant were misbranded in that they bore an EPA Establishment Number when the establishment in which the pesticides were produced was not registered with EPA. Eclipse Aurora HB when used in accordance with the label directions for hospital disinfection was ineffective againist Pseudomonas aeruginosa.
