Respondent failed to submit Material Safety Data Sheets (MSDSs) for lead, titanium, and tin (or a list of these chemicals) to the State Emergency Response Commission (SERC), the Local Emergency Planning Committee (LEPC), and the fire department with jurisdiction over the facility within three months after being required to prepare or have available a MSDS list for lead, titanium and tin. In violation of EPCRA Section 311. Respondent failed to timely submit a complete and accurate Tier II reports to include lead, titanium, and tin, to the SERC, the LEPC, and the fire department with juriscition over the facility for calendar year 200s. In violation of EPCRA Section 312.
