Case summary

3/24/03 - Referral sent to DOJ. Owners & operators of industrial process refreigeration equipment containing more than 50 pounds of refrigerant must have leaks repaired. Failed to conduct follow-up verification test to ensure leak has been repaired. Failed to notify EPA of leak past 30 days and failed to prepare retrofit or replacement plan and failed to retrofit or replace leaking equipment within 1 year of leak. Failed to certify to EPA that acquired approved refrigerant recovery equipment and that company is complying with requirement of the regulation. DuPont owns industrial process refrigeration equipment and comfort cooling equipment. National HVAC is the onsite contractor that operates the refrigeration equipment. Injunctive relief will require DuPont to repair, retrofit, or replace leaking equipment and comply with recordkeeping requirements and pay a civil penalty of $1,200,32
