Case summary
AO issued 11/20/2002. Respondent failed to implement the Erosion and Sedimentation Control Plan as approved and failed to have amendments to that Plan approved by the County as evidenced by the design of sediments basins on site and the addition of basins that were not on the approved Plan, in violation of Part I.A.2. of the Permit. Respondent failed to inspect erosion and sedimentation control facilities twice every seven (7) days as required by the Permit such records were not produced during the inspection and failed to maintain a rain gauge on site and subsequent rainfall records, in violation of Part I.B.1 of the Permit. Respondent failed to maintain a record of all inspections and failed to make such records available to the EPA and County inspectors, in violation of Part I.B.3. of the Permit. Respondent facility to comply with final imitations and controls for storm water discharges once distrubance on the site had begun as evidenced by the lack of maintenance on basisns, ponds, and silt fencing on site, failure to adhere to the requirements of the Plan, and the loss of sediments into the SWIM buffer, in violation of Part I.C.1 of the Permit. Respondent failed to provide the operation and maintenance necessary to operate the storm water controls at optimum efficiency as evidenced by the lack of maintenance on basins, ponds and silt fencing on site and the loss of sediments into the SWIM buffer, in violation of Part I.C.2. of the Permit. Respondent failed to properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) as evidenced by the lack of maintenance on basins, ponds and silt fencing on site, failure to adhere to the requirements of the Plan, and the loss of sediments into the SWIM buffer, in violation of Part II.C.1 of the Permit. Respondent failed to provide access to all records that are required by the Permit, in violation of Part II.D.5.b of the Permit.
