'9/24/02 - Region 4 forwarded a referral to request DOJ to institue proceedings to commence a civil action against PRPs Phillio Gaido and James Jobbs for violating 104(e) and 122(e)(3)(B) respectively. EPA forwarded 104(e) Requests for Information and Administrative Subpeonas to these former owner/operators of a battery recycling site and both PRPs have never complied with those requests. The site was remediated by one of the generators, Lucent Technologies; however, past costs still remain and EPA has attempted, over the years, to ascertain to ability of Mr. Hobbs and Mr. Gaido to pay for past costs. EPA is requesting that DOJ file suit to enforce compliance with the Requests for Information and administrative subpeonas and civil penaties for failure to do
