'CAFO issued 9/23/2002, assessing a penalty of $20,000. Count I - On December 28, 1999, Respondent discharged 4,850 gallons of waste corrosive liquids, including 126 gallons of hydrofluoric acid, from its Marietta facility was in excess of the quantity of such substance established in 40 CFR Part 117 and, therefore, was in a quantity that has been determined may be harmful under 40 CFR Part 117, in violation of Section 311(b)(3) of the Act. Count II - Respondent''s July 2000, discharge of oil from its Shelby facility caused a film or sheen upon and discoloration of the surface of the water and adjoining shorelines in violation of Section 311(b)(3).
