'CAFO issued 11/29/01, zero penalty assessed. Respondent spent $5,500 to come into compliance. Respondent failed to conduct at least once every three years, a reinspection of all friable and nonfriable known or assumed asbestos containing builing material (ACBM) in each building that Respondent leases, owns, or otherwise uses as a school building. Respondent failed to conduct an inspection of each school building that is leased , owned, or otherwise used as a school building to identify all locations of friable and nonfriable ACBM. Respondent failed to collect sufficient samples of floor tile from each homogeneous floor tile area at Jackson Preparatory School, and sheetrock, seam mud, and lay-in ceiling tiles were not sampled or identified as being suspect surfacing material. Respondent failed to notify in writing at least once a year, parent, teacher, and employee organizations of the abailability of the school''s management plan. Respondent failed to ensure that the management plan contained a true and correct statement signed by the LEA designated person which certified that the general LEA responsiblities have been and will be met. Respondent failed to include in the management plan a detailed description of preventive measures and response actions to be taken as it pertains to asbestos-containing floor tile and surfacing material in the Administration Building. Respondent failed to conduct on schedule, six-month periodic surveillance of all known friable and nonfriable asbestos containing building material (ACBM) located within Respondent''s school. Respondent failed to attach a warning label immediately adjacent to suspected ACBM assumed to be ACM located on pipes in the boiler rooms of the Junior or High School buildings at Jackson Preparatory School.
