DEFENDANT WESTLAKE IS GOODRICH'S SUCCESSOR IN INTEREST FOR THE VINYL CHLORIDE PLANT IN CALVERT CITY, KENTUCKY, AND HAD SEVERAL ADDITIONAL VINYL CHLORIDE NESHAP VIOLATIONS AFTER THE FEBRUARY 1990 SALE. WESTLAKE AGREED TO A $12,000 PENALTY. KENTUCKY OBTAINED A $5500 ADMINIST- RATIVE PENALTY, BUT ASILED EPA TO TAKE THE LEAD ON THE GOODRICH/WESTLAKE VIOLATIONS. DEFENDANT SIGNED A CONSENT DECREE ON JANUARY 21, 1992.
