EPA v. WILLARD AGRI-SERVICE OF GREENWOOD, LLC F/K/A (WILLARD AGRI-SERVICE OF GREENWOOD, LLC)

Case summary

On July 7, 2026 a Consent Agreement and Final Order entered into by the EPA and Willard Agri-Service, LLC f/k/a Willard Agri-Service of Greenwood LLC (Respondent) was filed with the Regional Hearing Clerk settling alleged violations of FIFRA. The violations were discovered as a result of an inspection conducted by the DDA into activities at Respondent's facility located at 22272 South DuPont Highway in Greenwood, Delaware. From this inspection, it was determined that in 2025 Respondent illegally produced pesticides at an unregistered establishment and sold two misbranded pesticide products, constituting unlawful acts under Sections 12(a)(2)(L) and 12(a)(1)(E) of FIFRA. The labels Respondent affixed to the two pesticide products did not include required information from EPA accepted labels including directions for use and precautionary statements, or the address of the producer, registrant or person for whom the products were produced. As the two pesticide products were delivered directly to and used by aerial applicators, Respondent's conduct created a potential harm to human health and the environment by omitting critical information, including PPE, first aid, mixing and application instructions. Respondent's conduct also created a potential harm to the FIFRA regulatory program by defeating the statute's goal in requiring pesticide registration of ensuring products distributed, sold and used in the U.S. do not cause unreasonable adverse effects on human health or the environment. The parties reached an agreement on a civil penalty of SIXTEEN THOUSAND AND NINE HUNDRED dollars ($16,900). In keeping with our goal to work with our Agency partners, the DDA was actively involved in the investigation by conducting the FIFRA inspection on behalf of the EPA. Additionally, DDA has been notified of this action and has raised no objection.
