Case summary

On September 29, 2026, a Consent Agreement and Final Order entered into by the EPA and Strittmatter Materials, LLC (Respondent) was filed with the Regional Hearing Clerk settling alleged violations of CAA, specifically violations of a September 29, 2025 administrative order on consent issued pursuant to Section 113(a) of the CAA (Order). The Order provided Respondent two options for complying with the Nonmetallic Mineral Processing NSPS, codified at 40 CFR 60, Subpart OOO (NMPP NSPS). Beginning September 30, 2025, Respondent failed to comply with either option. The EPA first shared these compliance concerns with Respondent via a December 22, 2025 email, and subsequently through a February 21, 2026 Notification of Compliance Issues letter and ultimately a July 7, 2026 Notice to Show Cause letter. An amendment to the Order was issued on consent on August 13, 2026 (Amended Order). Respondent has demonstrated that is operating its Facility in compliance with the Amended Order, and, as required by the Amended Order, that it applied to the MDE to have included as enforceable provisions in its operating permit the regulatory and additional monitoring, inspection, and recordkeeping provisions of its chosen option for complying with the NMPP NSPS. While there is no evidence or belief that Respondent violated the NMPP NSPS opacity standard, Respondent?s conduct created a potential harm to the CAA regulatory program by defeating the statute?s goal of having credible evidence from which to demonstrate compliance with regulations that protect health from the dangers of excess particulate air pollution. The parties reached an agreement on a civil penalty of FIVE THOUSAND dollars ($5,000). This case seeks to ensure that facilities that process nonmetallic minerals comply with applicable requirements in furtherance of the EPA?s Pillar 1, providing clean air to every American. MDE has been notified of this action and has raised no objection.
