Case summary
On August 25, 2026, 2026, Region 3 filed a Consent Agreement and Final Order (CAFO), simultaneously commencing and concluding an administrative enforcement action, against Dana Transport, Inc. for violations of RCRA C and the West Virginia federally authorized hazardous waste program at the facility located at 19 Plant Road, Nitro, West Virginia 25143 (the Facility ). The Facility's principal business is to lease transportation equipment and operate a tank wash. The settlement requires Dana Transport, Inc. to certify that it is now in compliance with applicable hazardous waste requirements and to pay a $38,640.00 penalty. The EPA notified the West Virgina Department of Environmental Protection in advance of this action, and the Department had no objections.
