EPA Region 3 Issues Consent Agreement and Final Order for Violations of RCRA Subtitle C to Sun Chemical [Docket No. RCRA-03-2026-0222]. On September 22, 2026, EPA Region 3 filed a Consent Agreement and Final Order ( CAFO ), concluding an administrative action proceeding against Sun Chemical Corporation ( Sun Chemical ) located at 3301 W. Hunting Park Ave., Philadelphia, Pennsylvania 19132 ( Facility ) for violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Pennsylvania Hazardous Waste Management Regulations, discovered during EPA's compliance evaluation inspection of the Facility on March 17, 2025. RCRA gives EPA the authority to control hazardous waste from the cradle-to-grave. This includes the generation, transportation, treatment, storage and disposal of hazardous waste. To that end, EPA develops regulations, guidance and policies that ensure the safe management and cleanup of solid and hazardous waste, and programs that encourage source reduction and beneficial reuse. Sun Chemical manufactures solvent-based and water-based inks. Hazardous waste generated through the manufacturing processes include solvent and solvent-contaminated waste. EPA alleged violations in the CAFO that include (1) Operating a Hazardous Waste Treatment, Storage, and/or Disposal Facility Without a Permit, Interim Status, or Valid Exemption to the Permitting Requirement; (2) Failure to Keep Containers of Hazardous Waste Closed; (3) Failure to Conduct Weekly Inspections of Hazardous Waste Accumulation Area; (4) Failure to Demonstrate Length of Time of Accumulation of Universal Waste Lamps; (5) Failure to Make a Waste Determination and (6) Failure to Have Required Content in Contingency Plan. Region 3 notified PADEP, which had no objections to this action. Per the terms of the CAFO, Sun Chemical will pay a civil penalty in the amount of $42,000.00.
